Single-speed road bikes and carbon fiber frames are exempt from U.S. tariffs

Data:2019-12-12 13:59:00

The United States trade representative (USTR) has approved a tariff waiver for carbon fiber frames made in China, eliminating the 25 percent tariff on imports. In addition, the exemption will be retroactive to the tariff date, so importers can claim reimbursement for the additional duties they previously paid. The product's tariff exemption, which is valid until August 7, 2020, applies only to frames imported separately, not as part of the vehicle. The waiver request was filed by Parlee Cycles in Beverly, mass.

Carbon fiber frames are just the second product in the bicycle industry to receive a tariff exemption from the 94 applications filed with the U.S. trade representative as of September 30, 2019.Another product on the list of tariff exemptions is single-speed road bikes, which were filed by State Bicycle. So far, the Delta Cycle bike rack (storage racks) is the only case was rejected.

Alex Logemann, policy advisor at PeopleForBikes, said, "there is absolutely hope that other waivers will pass, and we are optimistic that the current success bodes well for applications from other drivers.""All other bicycle products applying for tariff exemption are still in the phase ii process, which means they are undergoing preliminary substantive review. It would be a fairly positive sign if any of the applications made it to phase iii would be reviewed by customs and border protection."

Parlee Cycles has also applied for a tariff exemption for the carbon fibre front fork and is now in phase two.Parlee applied as early as Aug. 16, 2019, while most cyclists filed before the Sept. 30 deadline.CatEye's application for tariff exemption for its stopwatch Velo 7 bicycle entered the third phase on 29 October 2019.

Single-speed road bikes and carbon fiber frames are specific product types and are not listed under the Harmonized TariffSchedule-HTS import tax code. The duty-free frame applies to HTS 8714.91.3000, which is the frame (of any material) of a bicycle or other bicycle and is not more than $600 in value.According to the tax code, America imported nearly half a million frames (all materials) last year, worth $32m.From January to August 2019, about 200,000 frames were imported, with a total value of 21 million us dollars. The import volume dropped significantly. It is impossible to estimate the amount of carbon fibre frame imports.

The tariff on these products the year before was 3.9 per cent;It still exists today. The U.S. government imposed a 10 percent tariff in September and increased it to 25 percent in May.The us government had threatened to raise tariffs to 30 per cent on October 1 and 15, but has now indefinitely delayed raising them.

Trek bicycles have requested exemptions for frames (of any material) worth less than $600 and over $600.The company points out that the frames it USES in its Project 1 custom bike program are in the range of both, imported from Trek's Wisconsin plant.PeopleForBikes has filed a request for a tariff waiver on behalf of the owner for frames under $600.All applications are still in phase two.

"The cost of manufacturing these frames domestically is too high," Mr Parlee argued in his application for exemption. The company has hired a consultant to study the feasibility of adopting a third country plant, but if it now considers switching to a new manufacturer outside China, the initial costs would be high.In addition, the company is not considering passing on the cost of increased tariffs to consumers.Parlee also points out that frame technology is not strategic."China has been using this basic technology in its manufacturing processes for decades," the company said. "China's acquisition of technologies that are not yet available poses no threat."

On September 24, 2018, the United States imposed tariffs on about $200 billion worth of Chinese imports, including car frames.According to one study, the U.S. trade representative's office has approved nearly a quarter of requests for exemptions from new tariffs.
